If the judgement confines her to the State of Texas, then she will stand in contempt of court if she removes herself to another State. She might be jailed and her children might become Wards of the State.

If the marriage is still in contact then the mother and child can move to another state without the consent of the father. And if the divorce is imposed and the father has the legal custody of the child then the mother can't move without his consent.

If the mother has the legal custody then she can go anywhere with her son.

We need help! My friend recently went through a jury trial divorce in which she was awarded full custody of her two children ( 5 and 8 years of age) but has been confined to the state of Texas. Her family lives in another state and has been her only help financially and emotionally. She works full time and the support in which she was awarded and is NOT receiving from the father barely covers day care expenses. She wishes to move closer to her family. The children also wish to move. The father has control issues and a better attorney. He shows no interest in the children unless it is convenient for him. She has no intention of keeping the children from their father just wants a better life for them. Is there anyone who knows someone who can help? Please!
