This varies from state to state. If it was consensual sex and both were minors, in some states, this is not a serious crime. (These are often called "Romeo and Juliet" statutes). It may also depend on the difference in age - so 14 and 15 year olds together is not a crime, but 14 and 17 may be.
Some states draw a line at 16. Sex before 16 is statutory rape, regardless of the age of the other party.
If the parents don't want a prosecution to take place (they don't want to make a felon of their grand baby's Dad), it isn't likely to go forward.

Here, someone over 16 having sex with someone younger than 16 is considered rape. Anyway, I'm 14, and I don't want to be in a sexual relationship let alone impregnated. I've still got school and a life that I don't want to waste on a baby.
Yes he could, it's called statutory rape. Even though he had her consent she is considered a minor in the eyes of the law until she's 18.

That totally depends on the state, I know in Wisconsin both can be victim and both can be criminal, and both charged. Many states have an age differential, some states don't.
