Septic has taken  the 1st sentence out of my mouth.  The ring could be considered as a gift, if it was given to her prior to the proposal & acceptance of marriage, then this would entitle the wearer of the ring to keep it without any repercussions.  However, Best thing brought up the other half of my explanation wherein if said ring was given after asking for her hand in marriage and at that time she agrees to marry him, then we have a meeting of the minds & acceptance thus constituting an oral contract.  The ring must then be returned when the contract is breached.

Yes in some states there is a law that will force her to return the ring. If not he can take her to court and the judge will decide in most cases he will make her return it.

Yes, in the US She has to return the ring legally. She should return it on her own for moral and ethical reasons without having to involve the courts.

Yes.  If she calls off the engagement she returns the ring.  If he calls it off, she keeps the ring.

Yes because she when she was givin the ring it was in promise to you would be married and so she called it off there fore you get the ring back and you could sue for that

No, because it was a gift. Unless a legal contract has been made up pertaining to the rings, its hers. She'll sell it and spend the money on the chump she was really interested in. Life lesson #237.

an engagement ring is not a gift, it's a symbol of a promise made by both parties to get married. when the lady accepts his proposal and takes the ring, she is making a promise to marry him. if she calls it off, she is breaking that promise and must return the ring or pay him for it. if he calls it off, she keeps the ring. I've seen these cases go to court and that's how it goes unless there is severe extenuating circumstances.
