The ring could be considered as a gift, if it was given to her prior to the proposal & acceptance of marriage, then this would entitle the wearer of the ring to keep it without any repercussions. However, Best thing brought up the other half of my explanation wherein if said ring was given after asking for her hand in marriage and at that time she agrees to marry him, then we have a meeting of the minds & acceptance thus constituting an oral contract. The ring must then be returned when the contract is breached.
